Fallbrook Podiatry Inc. (referred to as “Fallbrook Podiatry,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our website (fallbrookfootdoctor.com, referred to as the “Site”). It also outlines your rights under applicable U.S. federal and California state privacy laws (including the California Consumer Privacy Act, or CCPA). By using our Site, you agree to the data practices described in this Privacy Policy. If you do not agree, please do not use the Site.
Information We Collect
Personal Information You Provide: We only collect personal information that you voluntarily provide through our Site’s contact forms or other direct interactions. This includes:
Contact Information: such as your name, phone number, and email address (collected when you fill out our “Contact Us” form or similar inquiry forms).
Message Content: any information you choose to include in the text of your message or inquiry. Please DO NOT include sensitive personal details or personal health information in your messages. Our website is not intended to collect any protected health information (PHI) about your medical condition or treatment. We ask that you refrain from submitting any health or medical details via the website.
Information Collected Automatically: When you visit our Site, we may automatically collect certain technical information about your device and usage of the Site for analytics and security purposes. This may include:
Usage Details: pages viewed, the date/time of your visit, the referring URL, and your browsing actions on our Site.
Device and Technical Data: your IP address, browser type, device type, operating system, and possibly general location (city/region) inferred from your IP.
Cookies and Tracking Technologies: We (or authorized third parties) use cookies and similar technologies to collect and store analytics information. For example, Google Analytics may place cookies to gather information about how you use our Site, which helps us understand traffic patterns and improve our content. These cookies and tools may automatically receive certain data about your device and browsing. (See Cookies and Analytics below for more details.)
We do not intentionally collect any information about your race, ethnicity, religion, sexual orientation, or other sensitive categories through the Site. We do not knowingly collect personal information from children under 13 (see Children’s Privacy below).
How We Use Your Information
We use the personal information you provide and information we collect for the following purposes:
To Respond to Inquiries: If you contact us through the Site (for example, by submitting the contact form with your name, phone number, and email), we will use your information to respond to your request. This may include contacting you via email or phone to schedule an appointment, answer your questions, or provide information you requested about our podiatry services.
Providing Services: We use your information to provide and support the services or information you seek. For example, your contact details help us follow up with you about your appointment request or discuss your needs as indicated in your message.
Communications: We may use your contact information to send you administrative information such as appointment reminders or important updates. Occasional Educational Messages: With your consent or as permitted by law, we might also send you occasional health newsletters or foot care tips by email. Any such communication will be infrequent and for informational purposes only – they are not personalized medical advice (see our Disclaimer). You have the choice to opt out of these communications at any time (see Your Rights & Choices below).
Site Improvement and Analytics: Information about how users navigate and use our Site (collected via cookies and analytics tools) helps us troubleshoot technical issues, understand user preferences, and improve the Site’s design, functionality, and content. For instance, analyzing which pages are most visited can guide us in enhancing those pages for a better user experience.
Security and Fraud Prevention: We may use IP addresses and other technical data to help monitor and prevent fraud, unauthorized access, or other illegal activities on our Site. This helps protect the integrity of our website and your information.
Legal Compliance: If necessary, we may use or disclose your information to comply with applicable laws, regulations, legal processes, or governmental requests. For example, we may retain certain information to meet record-keeping obligations or respond to a subpoena or court order.
We will not use the personal information we collected for materially different, unrelated, or incompatible purposes without updating this Privacy Policy or obtaining your consent.
Cookies and Analytics
Cookies: Cookies are small text files stored on your device by your web browser. Our Site uses cookies and similar technologies to ensure the Site functions properly and to help us understand and improve user experience. For example, we may use session cookies (which expire when you close your browser) to remember that you’ve visited certain pages, or persistent cookies (which stay on your device for a set period) to remember your preferences on the Site.
Analytics Tools: We use third-party analytics services such as Google Analytics. These services use cookies and scripts to collect and analyze information about Site use. The information collected may include your IP address, browser type, pages visited, time spent on pages, and other usage data. We use this information in aggregate form to compile reports and to help us improve the Site. Google Analytics may also set and read its own cookies. We do not provide Google with any personally identifying information like your name or contact info through these cookies.
Managing Cookies: You have the option to control or disable cookies through your browser settings. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. Note that disabling certain cookies may affect the functionality of our Site (for example, some pages may not remember your preferences). To opt out of Google Analytics specifically, Google provides a browser add-on tool for opting out (see Google’s site for more information).
“Do Not Track” Signals: Some browsers offer a “Do Not Track” (DNT) option that allows you to signal to websites that you do not want to be tracked across sites. Currently, our Site does not respond to DNT signals. There is no universal standard for DNT signals, and like many websites, we operate according to this Privacy Policy and the standards described here. We will update this policy if a standard for online tracking is established in the future that we decide to follow.
Third-Party Services and Links
Our Site may include links to external websites or integrations with third-party services. This includes, for example, links to our social media profiles (Facebook, Instagram, YouTube, etc.) or mapping services (such as an embedded Google Map for our office location). If you click on those links or use those features, you will be interacting with the third-party service, and their privacy policies will apply to any information they collect. We do not control and are not responsible for the content or privacy practices of any third-party websites.
Third-Party Service Providers: We may share certain data with third-party companies that perform services on our behalf related to the operation of the Site or our practice. For example, we might use a third-party website hosting provider, email delivery service, appointment scheduling software, or payment processing service. These providers may have access to personal information solely for the purpose of providing their service to us (for instance, to host our contact form submissions or to process an online payment), and they are contractually obligated to protect and use the information only for those purposes.
We do not allow third parties to collect your personal information from our Site for their own unrelated purposes (such as marketing) without your consent. If in the future we partner with any external service that involves your personal information, we will ensure that appropriate protections are in place and update this policy if necessary.
Sharing and Disclosure of Your Information
No Sale of Personal Information: We do not sell, rent, or trade your personal information to third parties for their own marketing or commercial purposes. In other words, we have not sold and will not sell personal information as defined under the CCPA.
Business Transfers: In the unlikely event that Fallbrook Podiatry Inc. undergoes a business transition such as a merger, acquisition, or sale of assets (for example, if another company acquires our practice or website), your personal information may be among the assets transferred. If such a transfer occurs, we will ensure that your information remains protected and subject to privacy commitments consistent with those in this Policy. We will also notify you (for example, via a notice on our Site) of any change in ownership or use of your personal information, as well as any choices you may have regarding your personal information.
Legal Obligations: We may disclose your personal information if required to do so by law or in the good-faith belief that such action is necessary to: (i) comply with a legal obligation, such as responding to subpoenas, court orders, or regulatory requests; (ii) protect and defend the rights or property of Fallbrook Podiatry Inc., our staff, or our patients; (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public; or (iv) protect against legal liability. For instance, if you post or transmit information in violation of our Terms and Conditions or applicable law, we might need to provide information to law enforcement.
With Your Consent: In all other cases not outlined above, if we ever need to share your personal information with a third party, we will obtain your consent beforehand. For example, if we wanted to use a testimonial you provided along with your name on our website, we would ask for your explicit permission.
Security of Your Information
We take reasonable and appropriate measures to protect the personal information submitted to us, both during transmission and once we receive it. Our website uses Secure Sockets Layer (SSL) encryption for data transmitted through the contact forms – you can verify this by the “https” and padlock symbol in your browser’s address bar when you submit information. This encryption is designed to protect your information from eavesdropping as it travels over the internet.
Internally, we restrict access to personal data collected through the Site to employees or agents who need that information to perform their duties (for example, responding to your inquiry or scheduling an appointment). We maintain physical, electronic, and procedural safeguards in line with industry standards to guard your information. For example, our computers and networks are protected by firewalls, and we implement access controls to our data.
However, no method of transmission over the Internet or electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. Any transmission of information is at your own risk. It’s important for you, as well, to protect against unauthorized access to any account or to your computer by using strong passwords and other protective measures. If you believe the security of your interaction with us has been compromised (for example, if you suspect someone has intercepted your communications), please notify us immediately using the contact information below.
Your Rights and Choices
We respect your rights to know about and control your personal information. Depending on where you live (for example, if you are a resident of California), you may have specific privacy rights regarding the personal information we hold about you. We extend many of these rights to all our users, and we describe them below:
General Privacy Choices (All Users):
Access and Update: You may contact us at any time to inquire about what personal information we have about you or to correct or update any personal information (such as your contact details) that may be out of date or inaccurate. We will honor reasonable requests to access, update, or delete information in accordance with applicable law.
Opt-Out of Communications: If you no longer wish to receive our newsletters or educational emails, you can opt out at any time. To do so, you can click the “unsubscribe” link in the footer of any marketing email you receive from us (if applicable), or simply contact us requesting to be removed from our mailing list. Please note that even if you opt out of marketing emails, we may still send you important administrative or transactional communications (such as appointment confirmations or policy updates), as permitted by law.
Cookie Preferences: As mentioned above, you can set your browser to refuse all or some cookies, or to alert you when cookies are being sent. Additionally, you can opt out of Google Analytics tracking by using the Google Analytics Opt-out Browser Add-on. Please be aware that disabling cookies might affect your experience on our Site.
Do Not Provide Optional Data: You have the choice not to provide certain optional information. For example, any fields that are not required in our contact form can be left blank. You also have the choice not to use the Site’s contact form at all if you do not wish to provide personal information online – you can always reach us via telephone instead.
Privacy Rights for California Residents (CCPA): If you are a resident of California, you are entitled to the following rights with respect to your personal information under the California Consumer Privacy Act (CCPA) and its amendments:
Right to Know: You have the right to request that we disclose what personal information we collect, use, and disclose about you. This includes the specific pieces of information we have collected, as well as the categories of sources of that information, our business purposes for collecting it, and the categories of third parties with whom we share it.
Right to Delete: You have the right to request deletion of personal information we have collected from you, subject to certain exceptions (for example, if we are required to keep certain information to comply with legal obligations or if the information is needed to complete a transaction you requested). Once we receive and confirm a verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
Right to Opt-Out of Sale: You have the right to direct us not to sell your personal information to third parties. Note: As stated above, we do not sell personal information. Therefore, although you have this right, there is no need to take any action to opt out of the sale of your data — because we don’t engage in that practice. If this ever changes, we will update this Privacy Policy and provide a clear “Do Not Sell My Personal Information” method on our Site.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we will not deny you services, charge you a different price, or provide a different level or quality of services just because you exercised your privacy rights under California law. The quality of care and service you receive from us will remain the same.
Right to Correct: (Effective January 1, 2023 under the California Privacy Rights Act) You have the right to request that we correct any inaccurate personal information we hold about you. If you believe any of your information is incorrect or incomplete, please let us know and we will work to correct it.
Shine the Light (California Civil Code §1798.83): California residents may also request information about certain categories of personal information we have disclosed to third parties for those third parties’ direct marketing purposes, if any. However, Fallbrook Podiatry Inc. does not share your personal information with third parties for their own direct marketing purposes. Therefore, there is no information to provide under this “Shine the Light” law. We take your privacy seriously and refrain from such marketing disclosures.
Exercising Your Rights: To exercise any of the rights described above (access, deletion, etc.), please contact us using the information provided in the Contact Us section below. For California residents making a CCPA request, please indicate that you are a California resident and provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information (for example, contacting us from the email address you used in our contact form and describing your interaction with us). We may need to ask for additional information to verify your identity for security purposes before fulfilling your request. Authorized agents may make requests on behalf of California residents, but we will require proof of the agent’s authority and verification of the identity of the consumer they represent.
We will respond to verified requests within the timeframe required by law (generally within 45 days, with the possibility of an extension under certain circumstances). If we cannot fulfill your request, we will explain the reason in our response (for example, if we must retain certain data for legal compliance or cannot verify your identity).
Children’s Privacy
Protecting the privacy of minors is especially important. Our services and Site are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 years old. If you are under 13, please do not submit any personal information through our Site. We ask that parents and guardians supervise the internet usage of their young children and instruct them not to provide personal data on this Site.
If we learn that we have inadvertently collected personal information from a child under 13, we will take prompt steps to delete such information from our records. If you believe that a child under 13 may have provided us with personal information, please contact us so that we can take appropriate action.
For teens between 13 and 18, if you use our Site or contact us, please do so only with the involvement or consent of a parent or guardian. Some state laws (like California Business & Professions Code § 22581) may permit minors under 18 to request removal of content they posted. However, our Site does not have public posting by users (such as forums or comments), so this likely does not apply. We still encourage any minor using our services to seek parental guidance.
Changes to This Privacy Policy
We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will revise the “Last Updated” date at the top of this Policy. Changes are effective immediately upon posting to the Site, unless otherwise noted.
If the changes are significant, we may provide a more prominent notice of the update (such as a banner on our Site or a notification via email if you have provided your email to us) to the extent required by law. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.
Your continued use of our Site after any updates constitutes your acknowledgment of the changes and your agreement to the updated Policy. If you do not agree to the revised terms, please discontinue use of the Site.
